Welcome to Home Connected. Please read these Terms and Conditions carefully before using our website or services. By accessing or using our Site or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Agreement to Terms

By accessing or using the Home Connected website ("Site") located at https://www.homeconnected.net, or by using any of our services, including but not limited to our utility concierge service, home service connection assistance, partner program, and directory services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Site or Services.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Castros Enterprises Inc d/b/a Home Connected ("Home Connected," "we," "us," or "our").

2. Description of Services

Home Connected operates a utility concierge and home services connection platform. Our Services include, but are not limited to:

Assisting consumers in identifying and connecting with utility and home service providers in their area, including electricity, gas, water, internet, phone, television, home security, mail forwarding, moving trucks, storage, movers, and wireless services.
Providing a free concierge service that helps schedule appointments and installations for home services on behalf of the consumer.
Offering a Partner Program for real estate professionals, property managers, mortgage and title companies, developers, builders, HOAs, movers, relocation companies, and apartment locators.
Maintaining a directory of service providers available in various geographic areas.

Home Connected acts as an intermediary concierge service. We do not directly provide utility or home services. All services are provided by third-party service providers, and your relationship with those providers is governed by their own terms, conditions, and agreements.

3. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding agreement to use our Services. By using the Site or Services, you represent and warrant that you meet these requirements.

4. User Accounts and Information

Certain features of our Services may require you to submit personal information through forms on our Site, including but not limited to your name, address, phone number, email address, and details about your moving date and service needs.

You agree to provide accurate, current, and complete information when using our Services. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Free Service for Consumers

Our concierge service is provided at no cost to consumers. Home Connected may receive compensation from third-party service providers for referrals and connections made through our platform. This compensation does not result in any additional charges or markups to you as a consumer.

6. Partner Program

Our Partner Program allows businesses such as real estate agencies, property management companies, mortgage companies, and other qualifying entities to refer their clients to our Services. Partners may be eligible for revenue sharing on certain services as outlined in separate partner agreements.

Participation in the Partner Program is subject to approval by Home Connected and governed by a separate Partner Agreement, which supplements these Terms. In the event of a conflict between these Terms and the Partner Agreement, the Partner Agreement shall control with respect to the Partner Program.

7. Third-Party Service Providers

Home Connected connects you with third-party service providers but does not guarantee, endorse, or warrant the quality, safety, legality, or availability of any services offered by these providers. Featured partners displayed on our Site, including but not limited to AT&T, Verizon, Xfinity, DirecTV, Frontier, and others, are independent companies, and Home Connected is not responsible for their products, services, pricing, or performance.

Any agreements you enter into with third-party service providers are solely between you and the provider. Home Connected is not a party to such agreements and shall not be liable for any disputes, claims, losses, or damages arising from your interactions with third-party providers.

8. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, trademarks, service marks, and software, is the property of Home Connected or its licensors and is protected by applicable intellectual property laws. Third-party logos and trademarks displayed on the Site are the property of their respective owners and are used with permission or under applicable licensing agreements.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the Site without our prior written consent, except as expressly permitted by these Terms.

9. Prohibited Conduct

You agree not to:

Use the Site or Services for any unlawful purpose or in violation of any applicable laws or regulations.
Submit false, misleading, or inaccurate information through any forms or communications on the Site.
Interfere with or disrupt the operation of the Site or the servers or networks connected to it.
Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks.
Use any automated means, including bots, scrapers, or spiders, to access or collect data from the Site without our express written consent.
Impersonate any person or entity or misrepresent your affiliation with any person or entity.
Use the Site in any manner that could damage, disable, overburden, or impair the Site.

10. Privacy

Your use of the Site and Services is also governed by our Privacy Policy, available at https://www.homeconnected.net/privacy-policy. By using the Site and Services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

11. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

HOME CONNECTED DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. HOME CONNECTED DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT ON THE SITE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HOME CONNECTED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE OR SERVICES.

IN NO EVENT SHALL HOME CONNECTED'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR SERVICES EXCEED THE AMOUNT YOU HAVE PAID TO HOME CONNECTED, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Home Connected, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Site or Services; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any information you provide through the Site.

14. Modifications to Terms

Home Connected reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site or Services after any modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

15. Modifications to Services

Home Connected reserves the right to modify, suspend, or discontinue any part of the Site or Services at any time, with or without notice, and without liability to you.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in San Bernardino County, California, for the resolution of any disputes arising out of or relating to these Terms or your use of the Site or Services.

17. Dispute Resolution

Before initiating any legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at info@myhomeconnected.com. If a dispute is not resolved within thirty (30) days of the informal dispute notice, either party may proceed with formal legal action as permitted under these Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any applicable Partner Agreements, constitute the entire agreement between you and Home Connected regarding your use of the Site and Services and supersede all prior and contemporaneous agreements, understandings, and communications, whether written or oral.
